Cancellation policy

Your right of cancellation with xtivate

Consumers have a statutory right of cancellation for online orders and distance selling contracts in accordance with § 312g BGB (German Civil Code) pursuant to § 355 BGB. In accordance with Art. 246a para. 2 sentence 1 EGBGB, we hereby inform you about the conditions, deadlines and consequences of a cancellation.

Right of cancellation

You have the right to cancel this contract within 14 days without giving any reason.

The cancellation period begins:

For purchase contracts: 14 days from receipt of the goods by you or a third party designated by you (excluding the carrier).
For orders of several items with separate delivery: 14 days from receipt of the last item.
For delivery in instalments: 14 days from receipt of the last instalment.
For digital content or services: 14 days from conclusion of the contract.

How to exercise your right of cancellation:

You can use the attached sample cancellation form - however, this is not mandatory.

Important: To meet the cancellation deadline, it is sufficient for you to send your notice of cancellation before the deadline expires.

Exceptions to the right of cancellation

There is no right of cancellation in the legally regulated exceptions according to § 312g Para. 2 BGB (German Civil Code). We would particularly like to point out § 312g Para. 2 No. 6 BGB: Software in sealed packaging is excluded from the right of cancellation if the seal has been removed after delivery.

Consequences of cancellation

Repayment:

After your cancellation, we will refund all payments made, including delivery costs (excluding additional costs for a different shipping method).
The refund will be made within 14 days of receipt of your cancellation notice.
We will use the same means of payment for the refund that you used for your order - unless an alternative method of repayment has been agreed.
You will not incur any fees for the refund.

Returning the goods:

We may refuse to refund you until we have received the goods back or we have proof that you have returned them.
You bear the direct costs of returning the goods.

Important: You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
